Hi Folks,
I have a question on the Residential Tenancy Act (Ontario). I am asking from the perspective of a tenant (my girlfriend) who is trying to move out of her apartment, but I would also like to be clear on this as a landlord.
Unfortunately she was only able to give approximately 1.5 months notice to terminate, and the landlord told her she would be on the hook for the second month's rent if they weren't able to rent it by then. That is fair, but they are trying to rent the place for $150 more than she was paying and I think it will be difficult to get tenants at that rent. My question is about Assignment. From what I understand, she can assign her tenancy even though she is month-to-month, but her landlord disagrees. Anyone an expert here?
Assuming they don't allow the assignment or don't respond, the second question is about timings. Assuming they do not respond to her request within 7 days, does this timeline make sense?
23 July - Request to Assign
30 July - Notice to terminate on 31 August
31 August - Move out
I am just unsure of when the 30 day notice can be given. From the date she requests to assign, or 30 days from when she gives notice to terminate.
ie would this be possible:
30 July - Request to Assign
6 August - Notice to Terminate on 31 August
31 August - Move out
